Context of Need
The Contract Managers, with the support of Corporate Legal, is responsible for preparing, negotiating, and recording business contracts on behalf of the Hydrogen Business.
The Contract Manager has to be shrewd and knowledgeable about the details and potential benefits of the contracts within the Hydrogen Division.
During project execution the Contract Manager, in good relationship with the project team, will work based on the contract specification to protect John Cockerill project's interests.
The Contract Manager is under the hierarchical responsibility of the CFO and may refer to the Corporate Legal Department for specific legal topics.
Objectives
- The Contract Managers is responsible for preparing, negotiating, and recording business contracts on behalf of the Hydrogen Division in order to prevent the Project against claims or litigation from supplier and/or customer
- The Contract Manager makes sure formal notification are sent to supplier or customer whenever contractual obligation are not met
- Support of the project team for their budgetary and financial compliance of the project, especially when there is a risk or opportunity on both technical and commercial side
- Contract oriented, he/she gives contractual/juridical answers (with support of Corporate Legal) to the project team main issues and supports them in case of conflictual negotiations
Main Duties
The Duties of The Contract Manager Are Amongst Others:
- Analyze, study and understand the project contract
- Draft, review and negotiate the contract and its evolutions (change of scope, disputes, penalties...) based on the analysis of the project team/proposal team/warranty team
- Advice the project team in the choice and implementation of administrative and contractual procedures related to the project life
- Evaluate opportunities to improve the performance of the contract: generate and negotiate amendments to the contract
- Mediate in case of conflict or crisis in the project life with customer and or supplier
- Prepare litigation files and participate in legal expertise, customer meeting, supplier meeting
- Participate in negotiations with insurers, financiers, management, customer, suppliers, etc.
- Monitor the respect of the contractual Terms and Conditions
Profile
The Contract Manager has a specialist profile. He/she must be available for temporary missions, sometimes on short notice, including international travel and can work on several projects in parallel
Skills
- Fluent in English (reading, writing, speaking, listening)
- Able to analyze quickly a contract identifying the points of attention
- Able to quickly identify the risks and opportunities of a project
- Gain insight quickly in problematic situations in complex environments
- Elaborate and deploy a resolution methodology
- Elaborate recommendations, propose solutions and scenarios for improvement
- Knowledge of taxation, insurance and accounting is a plus
- Ensure the administrative and economic management of a contract, amendment.
- Manage commercial disputes and be the SPOC towards other colleagues / management
- Draft or verify the conformity of a contract
- Common sense and able to work independently
- Stress resistant
